August 23, 2007:  FDNY finally issues an S.O.P. with regard to the Deutsche Bank Building.  It comes 2 years and 8 months after the Ten House requested an S.O.P. and 6 years after the Deutsche Bank building became toxic in 9/11/2001.  To see it, click here.  Note:  it requires on page2 in item 5A " Everyone entering building for non fire related emergencies and routine entries must wear tyvek suit and respirator"  FDNY did not supply Tyvek Suits to the Ten House. June 14, 2006    Memo from Bob Fitzpatrick to Pat Evangelista in which it was said "After hearing that the material failed badly, Don Adler [of John Galt] stated something to the effect that this building isn't subject to any regulation, so what standard could it possibly fail. March 21, 2006    The initial site visit of CH2MHILL and EPA to 130 Liberty Street and the initial kickoff meeting. Bovis gives them iniitial safety training.  TRC contributes to their iniital safety training in regards to "general site rules and procedures".  FDNY is not present of the initial kickoff meeting or for the initial site inspecton (Note:  EPA enters the picture and FDNY exits. March 2006    In mid-March, the Lower Manhattan Development Corporation announced the completion of the exterior scaffolding and the start of abatement of 130 Liberty Street, as well as the installation of the tower crane. This will allow for physical floor by floor deconstruction to begin in June. The building is expected to be deconstructed by spring of 2007. LMDC President Stefan Pryor said, “We've worked closely with the community and federal, state and local regulatory agencies to ensure this process is carried out in a safe and effective manner.” General contractor Bovis Lend Lease has hired John Galt Corporation as the abatement and deconstruction subcontractor. Required notifications for the abatement have been submitted to the New York State Department of Labor, New York City Department of Environmental Protection, and the United States Environmental Protection Agency. LMDC acquired 130 Liberty Street, the former Deutsche Bank Building, in 2004 and hired environmental consultants to conduct environmental testing and characterization of the building. The results of these tests are public, and a daily exterior air monitoring program was implemented by the LMDC to protect the surrounding neighborhood throughout the deconstruction process. This program includes 12 air monitors in and around the site to measure the environmental impact at all stages of the project. November 23, 2004    LMDC announces "... the LMDC has been working diligently on developing a comprehensive deconstruction plan which includes an Emergency Action Plan, a Health and Safety Plan and other components that will explicitly detail the proposed cleaning and deconstruction of the building. February 26, 2004  A settlement is reached between Taunus Corporation (Deutsche Bank) and its insurers with respect to "the Items on the Proof of Loss for “130 Liberty Building” (stated in the amount $642,860,271) and “130 Liberty Teardown” (stated in the amount of $231,370, 061) and all subentries included therein as set forth in the Proof of Loss and schedules thereto (“Resolved Entries”)." October 1, 2003    FDNY SAYS THEY’RE READY; COUNCIL COMMITTEE WANTS TO BE SURE. NYC Council Committee hearing re HAZMAT capabilities of FDNY.  During a September 2002 hearing, Commissioner Scoppetta testified that, “[W]e have only one HAZMAT unit at present. We need at least one more and have applied to FEMA to fund that.” Nonetheless, due to lack of sufficient funds, the Department subsequently shifted its resources to providing all firefighters with some HAZMAT training, rather than create a second HAZMAT unit. August 11, 2003    Deutsche Bank AG announces that it has filed a lawsuit against insurance providers Allianz Insurance Company, Axa Corporate Solutions Insurance Company and Axa Global Risks US Insurance Company in order to reach an expedited resolution over the fate of its 130 Liberty Street building in lower Manhattan, which suffered extensive contamination and physical damage on September 11, 2001. The case is entitled, TAUNUS CORPORATION vs. ALLIANZ INSURANCE COMPANY and is filed in Supreme Court New York County under Index # 602519/2003.
