August 5, 2003 : LMDC and FDNY interact

    LMDC, in the process of preparing its Generic Environmental Impact Statement (GEIS), repeatedly announced that a site specific, fire safety plan was necessary.  LMDC talked about a fire safety plan that was created by, reviewed by and approved by FDNY. Click here to see the evidence.   If such a plan was necessary, why did LMDC proceed without it?  Why was any work done at 130 Liberty Street without a site-specific fire safety plan in LMDC's hand?  In an official governmental document - the GEIS, LMDC announced and acknowledged the necessity of an FDNY created, reviewed and approved fire safety plan.  On August  5, 2003, Chief of FDNY Operations, Salvatore Cassano, responded to an inquiry by AKRF, INC., Environmental and Planning Consultants for LMDC telling them that FDNY has not received any plans from LMDC for FDNY review. Cassano even assigned a contact person for LMDC to facilitate LMDC's submission of plans for FDNY review.

    What did LMDC submit, when and to whom? 

    What did LMDC do when it failed to receive a site specific fire safety plan "created", "reviewed", and "approved" by FDNY?  Where is the request from LMDC to FDNY asking for the site specific fire safety plan? Where is LDMC's complaints that FDNY has not supplied them with a site specific fire safety plan and that the project could not proceed without one? Surely, LMDC wouldn't proceeed without one, would it?  Cassano told them that FDNY did not have its plans. What did LMDC do after it received Cassano's Letter?

    Keep in mind that on 12/1/2005, LMDC claimed in a press release that "protocols" were in place for various emergency scenarios.  Did FDNY create, review or approve these "protocols"? Did these "protocols" even exist?  To see the 12/1/2005 Press Release, Click here.

    Note:  the presence or absence of a site specific fire safety plan for 130 Liberty Street was an issue handled by the very top of FDNY.  Captain Peter Bosco was not even assigned to the TEN HOUSE when events concerning the site-specific fire safety plan happened.  Any site-specific fire safety plan was an issue above the rank of Captain and above the local firehouse. It was a headquarters issue.
