The LMCCC

The Lower Manhattan Construction Command Center was born on November 22, 2004.  Its biological parents were Governor Pataki and Mayor Bloomberg.  It came into being by a gubernatorial executive order and a mayoral executive order

In its Wherefore Clauses it explicitly states that

WHEREAS, the lead construction personnel for the key agencies involved in the rebuilding have been meeting regularly as the Lower Manhattan Construction Coordination Group;   

Was FDNY part of the Lower Manhattan Construction Coordination Group that was meeting regularly? Did the Mayor and the Governor consider FDNY a key agency involved in the rebuilding?  Or was FDNY excluded?

 Of significance is a portion of the executive orders that says

4. City Operations. A Director of City Operations will be  appointed by the Mayor, after consultation with the Command Center  Executive Director, to ensure the quality of life of residents and  businesses of Lower Manhattan, to coordinate the various municipal  services as they interface with the construction projects and to  ensure that the various logistics and traffic management plans are  appropriately enforced. The Director of City Operations will serve as  the liaison between the Executive Director of the Command Center and  all City agencies and will be located at the Command Center.    

Who was the director of City Operations? The Director of City Operations had responsibility "... to coordinate the various municipal services as they interface with the construction projects ..."  The Director of City Operations was supposed to " ... serve as the liaison between the Executive Director of the Command Center and all City agencies .. "  In what manner did the Director of City Operations "coordinate" the FDNY as FDNY "interfaced" with the Decontamination - Deconstruction of 130 Liberty Street? Did the Director of City Operations interface at all with FDNY? Did Director of City Operations act as a liaison for FDNY and LMCCC?

 Of significance is a portion of the executive orders that says

 5. Participation by Public and Private Partners. The Command  Center will coordinate between high level construction personnel from  the key participants in the rebuilding process including ... the New York City Fire Department ...

Who was the "key participant" from FDNY? Surely Bloomberg and Pataki were not "fibbing" in their November 22, 2004 Executive Orders and they did indeed have a "key participant" from FDNY in mind when they issued the Executive Orders!  Surely a Captain in the local fire house was not the "high level construction personnel" that Bloomberg and Pataki had in mind who would be "coordinating" with the LMCCC? Who was it Bloomberg? Who was it Mr. Pataki?  Who was FDNY's "key participant"?

 Then the Executrive Orders did something important. They formed the creme de la creme of key project participants into an Executive Committee. Notable is the absence of FDNY from the Executive Committee

In paragraph 9 of the Executive Orders, the functions of the LMCCC were listed.  Site Safety and site access was to be coordinated by the LMCCC.

In paragraph 10, all agencies were to cooperate fully with LMCCC.  In other words, via paragraph 10, the Governor of the State of New York and the Mayor of the City of New York put LMCCC in charge.
