LMDC is trying to dodge the Regulators. It does not have to dodge FDNY.
According to US EPA, LMDC is now trying to dodge the Regulators. US EPA has identified the planning process to consist of the following steps: 1) submission of a plan to the regulators for 2) review, 3) comment and 4) acceptance. US EPA in the letter dated 11/8/2007 accuses LMDC of abandoning this process. Instead of going before all of the Regulators, it is now trying to just go before the NYS DOL. Why? Is LMDC trying to skirt the US EPA's demand for safety? In any event, keep in mind that FDNY was not a "regulator" to whom plans had to be 1) submitted 2) reviewed, 3) commented upon and 4) Accepted. FDNY was intentionally kept out of this loop. Notice that the US EPA letter is not even circulated to FDNY. Why? Because US EPA knows that FDNY was not one of the regulators of this project. The funny thing is that this letter went to NYC Deputy Mayor Edward Skyler. Do you think he has told his boss, Mayor, 'the bloom is off the berg' Bloomberg that FDNY is not involved as a Regulator in this project?
