Monkey in the Middle
A policy of non-inspection of the Über-toxic Deutsche Bank Building pre-existed and, was firmly in place, well before Captain Peter Bosco's arrival at the TEN HOUSE, the local firehouse. According to an official mayoral press release (Click Here or Click Here), the last FDNY "surveillance inspection" of 130 Liberty Street occurred on March 31, 2006 - that is about nine or ten (9 or 10) months before Captain Peter Bosco's arrival at the Ten House and about seventeen (17) months before the fatal fire of August 18, 2007. Obviously, Captain Peter Bosco inherited the policy of non-inspection of the Über-toxic Deutsche Bank Building . He did not originate it. Obviously, the policy was originated by someone else.
Moreover, since the origination of policy of non-inspection of the Über-toxic Deutsche Bank Building at the end of March 2006, no FDNY superior officer ever criticized it, commented upon it, asked questions about it, questioned it or otherwise tried to change it until after the fatal fire of August 18, 2007. That is a period of about seventeen (17) months. This bears repeating. The policy of non-inspection of the Über-toxic Deutsche Bank Building stood in place for a period of seventeen (17) months.
After the arrival of Captain Peter Bosco at the TEN HOUSE in late December 2006 early January 2007, no superior officer - either immediate or remote - ever criticized him for not inspecting 130 Liberty Street or even ask him any questions about inspections of 130 Liberty Street. While Captain Peter Bosco was at the TEN HOUSE, he came into contact with superior officers that ranged from Battalion Chief to the ball less, brainless, heartless, FDNY Commissioner himself (Give the speech, Nick click Here). To the man, none criticized or even questioned Captain Peter Bosco about what was going on with regard to inspections of the Über-toxic Deutsche Bank Building. It was as if everybody understood that inspecting 130 Liberty Street was a role not assigned to the FDNY with regard to the deconstruction - decontamination of the Über-toxic Deutsche Bank Buildings. In fact, when Captain Peter Bosco's superiors reviewed and evaluated his inspection work at the TEN HOUSE, not only was there no criticism, he was told he was "still on target" ("but always foremost in my mind is to look after my men." When we were children, the game of 'Monkey in the Middle" was played. It is a very frustrating game to the "Monkey in the Middle". The goal is to toss a ball from player to player keeping it away from the "Monkey in the Middle". Right now, Mayor Batberg and Boy Blunder (Click Here) are tossing the ball of innocence - to and fro - trying to keep it from Captain Pete Bosco, FDNY's "monkey in the middle". For 17 months - 9 months before and 8 months after Captain Peter Bosco arrived at the TEN HOUSE - the policy of non-inspection of the Über-toxic Deutsche Bank Building was in place. During those 17 months the very top of FDNY had numerous opportunities to change it - if that was truly want they wanted to do (click here). That the policy of non-inspection of the Über-toxic Deutsche Bank Building was in place for so long is, in and of itself, evidence that non-inspection was the official policy of FDNY. Couple the policy's long duration with the other facts:
- FDNY did not provide the TEN HOUSE with a site specific safety plan,
- FDNY did not provide the TEN HOUSE with Tyvek suits,
- FDNY did not drill the TEN HOUSE on how to conduct inspections of the Über-toxic Deutsche Bank Building,
- FDNY did not have a department-wide rule or procedure on how to inspect toxic buildings,
- FDNY did not provide the TEN HOUSE with decontamination gear
- FDNY had no jurisdiction over the the Über-toxic Deutsche Bank Building
- FDNY's TEN HOUSE issued a cry for help on the DECEMBER 4, 2004 (Click Here) asking the FDNY to give it guidance on how to handle the Über-toxic Deutsche Bank Building
- etc.
- etc.
and the only possible conclusion that can be reached is that the role of inspector of of the Über-toxic Deutsche Bank Building was not the responsibility of the TEN HOUSE
