Has FDNY now become a Regulator of the Decontamination - Deconstruction of the toxic Deutsche Bank Building?

We learned what constitutes a regulator through the 11/8/2007 Letter of the U.S. E.P.A. (Click Here) complaining that LMDC was attempting to circumvent the regulatory process.  A regulator is someone to whom a plan is submitted for review, comment, rejection or acceptance. The question is whether FDNY has now become a regulator of the Decontamination - Deconstruction of the toxic Deutsche Bank Building?  In the New York Post on 12/13/2007, Chuck Bennett, in an article entitled, DEUTSCHE BANK STILL IN STRIFE  quoted FDNY Commissioner, Nicholas Scoppetta as saying that FDNY has not "signed off" on the project.  A "sign-off" by FDNY has heretofore not been needed during the Decontamination - Deconstruction of the toxic Deutsche Bank Building. Has FDNY's status changed? Have the powers that be upgraded FDNY to the status of regulator? From Scoppetta's "sign-off" comment, it certainly appears that it has.
