Part 800 of the Code of Rules and Regulations of the State of New York

    The New York Code of Rules and Regulations is broken down into Titles.  Tile 12 deals with the Department of Labor.  Title 12 is broken down into Chapters.  Chapter XI is entitled Division of Safety and Health.  Chapter 11 contains subchapter A which is entitled "THE INDUSTRIAL CODE PUBLIC EMPLOYEES' SAFETY AND HEALTH". Subchapter A is further broken down into Parts.

    PART 800 is entitled, "PUBLIC EMPLOYEES' OCCUPATIONAL SAFETY AND HEALTH STANDARDS".

    In 12 NYCRR § 800.1, it says:

   This Part promulgates occupational safety and health standards for the protection of the lives, safety and health of public employees in compliance with the mandates of Labor Law, section 27-a.

     In 12 NYCRR § 800.2, it says:

 Labor Law, section 27-a, subdivision 4a, requires the Commissioner of Labor by rule and regulation to adopt, for the protection of the safety and health of public employees, all safety and health standards promulgated under the United States Occupational Safety and Health Act of 1970 (Public Law 91-596) in effect on December 27, 1980, and to promulgate and repeal such rules and regulations as may be necessary to conform to the standards established pursuant to that Federal enactment.

  In 12 NYCRR § 800.3, The Commissioner of Labor adopted a multitude of standards "as the occupational safety and health standards for the protection of the safety and health of public employees" in the State of New York.

These standards as being part of the law of the State of New York trump any internal rule of the FDNY, a department of the City of New York.

One of the standards adopted was 12 NYCRR § 800.3(n) entitled "Hazardous Waste Operations and Emergency Response. 29 CFR Part 1910; Federal Register Volume 54, No. 42, Part III, pp. 9294 through 9336, Monday, March 6, 1989."

Another standard adopted was 12 NYCRR § 800.3(bh) entitled, " Personal Protective Equipment, 59 Federal Register 16360-16364, April 6, 1994. "

Another standard adopted was 12 NYCRR § 800.3(bn) entitled, "Occupational Exposure to Asbestos; General Industry, 59 Federal Register 41057-41080, August 10, 1994."

There are many other Federal Standards adopted.
